Notice and Takedown Policy

UpScrolled Video Downloader respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid copyright infringement notices.

Important Information About Our Service

Before filing a DMCA notice, please understand how our service works:

  • We do not host any content: Our service does not store videos on our servers
  • We process in real-time: Videos are streamed and converted in real-time, then immediately deleted
  • We are a tool: We provide a tool that allows users to download publicly accessible videos
  • Content is on UpScrolled: If your content is being shared without permission, the original content exists on UpScrolled's platform

If you believe your content is being shared without authorization, we recommend first contacting UpScrolled directly to have the source content removed.

Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content accessible through our service infringes your copyright, you may submit a DMCA takedown notice.

Required Information

Your notice must include:

  1. Identification of the copyrighted work: Describe the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.
  2. Identification of the infringing material: Provide the specific URL(s) or description of where the allegedly infringing material is located or accessible.
  3. Your contact information: Include your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Signature: Your physical or electronic signature.

Response to Valid Notices

Upon receiving a valid DMCA notice, we will:

  • Review the notice for completeness and validity
  • Take appropriate action, which may include blocking access to specific URLs or content
  • Make a good faith effort to contact the user who may have made the content accessible (if identifiable)
  • Document the notice and our response for legal compliance

Counter-Notification

If you believe that material was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its previous location
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement consenting to jurisdiction of the federal court in your district
  6. A statement that you will accept service of process from the complainant

Repeat Infringers

We maintain a policy of terminating access for users who are repeat infringers in appropriate circumstances. This may include blocking IP addresses or taking other measures to prevent continued infringement.

False Notices

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
